SiteSnapped provides commercial real estate property inspection software and related services, including but not limited to inspection management tools, report generation, compliance tracking, and asset assessment solutions. We reserve the right to modify, suspend, or discontinue any part of our Services at any time.

3. User Accounts

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for their intended purpose. This license does not include the right to copy, modify, distribute, sell, or lease any part of our Services.

6. User Content

You retain ownership of any content you submit, post, or display through our Services ("User Content"), including property inspection data, photos, and reports. By submitting User Content, you grant SiteSnapped a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving our Services.

You represent and warrant that you have all necessary rights to submit User Content and that such content does not violate any third-party rights or applicable laws.

7. Payment Terms

If you purchase any paid Services, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise specified. We reserve the right to change our pricing with reasonable notice. Continued use of paid Services after a price change constitutes acceptance of the new pricing.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

SiteSnapped does not provide professional property inspection advice. Our software is a tool to assist qualified professionals in conducting inspections. Users are responsible for ensuring compliance with all applicable regulations and standards.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITESNAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless SiteSnapped and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our Services, your User Content, or your violation of these Terms.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts located within the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
